These Terms & Conditions (“Terms”) apply to your use of our websites, lead forms, landing pages, and digital advertisements, and any communications you receive from us (including calls, texts, emails, and AI-assisted messages). 1) Who We Are & What We Do
Hair Transplant Marketing is a marketing and intake coordination agency. We help people who inquire about hair restoration and related services by:
responding to enquiries,
collecting information to understand what you’re looking for,
answering general (non-medical) questions about next steps, and
helping facilitate scheduling or referrals with third-party providers (where applicable).
We are not a clinic and do not provide medical services or medical advice. Any clinical advice, diagnosis, treatment decisions, pricing, eligibility, or outcomes are the responsibility of the treating clinic or provider.
2) Eligibility
By submitting your information, you confirm that:

You expressly authorize the Agency to use advanced communication technologies to facilitate your inquiry, including:

Robocalls and prerecorded voice: including voice messages generated by AI technology.
Generative AI agents: AI-driven voice or text assistants that may conduct intake, answer common questions, route you to a team member, and facilitate scheduling.
You understand that communications may be automated and/or AI-assisted.
5) Opt-Out & Revoking Consent
You can revoke consent at any time.
SMS Opt-Out
Reply STOP to any SMS message to opt out. You will receive one final message confirming your opt-out.
Email Opt-Out
Use the unsubscribe link (if included) or email us at [insert support email] with “Unsubscribe” in the subject line.
Calls Opt-Out
Tell us during any call that you do not want to be contacted again, or email [insert support email].
We will process opt-out requests within a reasonable time.

Costs: Message and data rates may apply based on your carrier plan.
Frequency: Message frequency varies based on your interaction and enquiry status.
Carrier Liability: Carriers are not liable for delayed or undelivered messages.
Supported Carriers: Mobile carriers including (but not limited to) T-Mobile, AT&T, Verizon and others may be used depending on region.

scheduling teams,
customer support tools and CRMs,
messaging and calling providers,
analytics and advertising platforms,
only as needed to respond to your enquiry, facilitate scheduling, and improve performance of campaigns and communications, as described in our Privacy Policy.
Third-party clinics/providers may contact you directly after receiving your information. Their services, medical decisions, and privacy practices are governed by their own policies.
9) Call Recording (If Used)
We may monitor and/or record calls for quality assurance, training, compliance, and dispute resolution purposes.
If legally required, we will provide notice at the start of the call. By continuing the call, you consent to recording.
10) Accuracy, Authority & Indemnification
You represent that:
you are the primary subscriber or authorized user of any phone number you provide, and
you will not submit someone else’s information without their permission.
If you provide a number you are not authorized to use, you agree to indemnify and hold the Agency harmless from any claims, losses, costs, liabilities, and expenses arising from communications sent to that number.
11) No Medical Advice / No Guarantees
We do not provide medical advice. Any information we share is general and informational only.
We do not guarantee:
that you will be eligible for treatment,
that an appointment will be available within a certain timeframe,
any specific outcome, results, or medical suitability,
that a provider will accept you as a patient.
Results depend on the provider, your circumstances, and clinical decisions outside our control.
12) Prohibited Uses
You agree not to:
misuse our forms or communications,
submit false or misleading information,
interfere with our systems or attempt to access them without authorization,
harass or abuse staff, providers, or automated systems,
use our services for unlawful purposes.
13) Disclaimers
To the maximum extent permitted by law:
our services and communications are provided “as is” and “as available,” and
we disclaim warranties of any kind (express or implied) including fitness for a particular purpose and non-infringement.
14) Limitation of Liability
To the maximum extent permitted by law, the Agency will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to:
your use of our website, forms, or communications,
delays or failures in message delivery,
actions or decisions of third-party providers/clinics,
your reliance on informational communications.
If liability cannot be excluded, it is limited to the minimum amount permitted by law.
15) Mandatory Arbitration & Class Action Waiver
Any dispute or claim arising out of or relating to these Terms, our Privacy Policy, your inquiry, or our communications will be resolved by binding individual arbitration in New South Wales, Australia.
You waive:
the right to a jury trial, and
the right to participate in any class action or class-wide arbitration.
Nothing prevents either party from seeking urgent injunctive relief where permitted.
16) Governing Law
These Terms are governed by the laws of the State of New South Wales, Australia, without regard to conflict of law principles.
17) Changes to These Terms
We may update these Terms from time to time. The “Effective Date” at the top indicates when the latest version applies. Your continued use of our services after changes means you accept the updated Terms.
18) Severability / Entire Agreement / Assignment
Severability: If any part of these Terms is found unenforceable, the rest remains in effect.
Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement regarding your use of our services.
Assignment: We may assign these Terms as part of a merger, acquisition, restructure, or transfer of assets.
